Banner Health also took action again Ms. Trujillo’s nursing license and she has been unable to practice nursing for the past 10 months.
Nurses everywhere are standing with Amanda Trujillo and coming together and putting their money where their blog is…. or something. The point is, the community is supporting Amanda with more than just their words.
This is about more that one nurse. This is about more than one patient. This is about a culture of healthcare that has to change.
Nurses are fighting so hard to be able to practice to the full extent our license. Educating patients is at the very core of our profession and no nurse should ever feel their job will be threatened when the advocate for their patients and do the right thing.

Nurses all over the US are upset and simply can't understand how on earth a nurse could be fired for being a patient advocate, educating her patient on all aspects of their care and explaining in detail treatment plans, which led to a greater understanding by her patient and subsequent change in plans. Amanda Trujillo is an advocate for her patients, she did what we all do every shift that we work, make sure our patients understand what is wrong with them, the plan of care, which includes educating them on any treatments, procedures, medications, surgeries, activities or anything else the patient or family asks of us.
It is common for patients in the hospital setting to lack the knowledge they need to make informed decisions, whether it be the stress of the situation or the educational level of your patient. You are not thinking clearly as the patient in that hospital bed (I have been that patient before) and the doctor comes in to talk to you, he talks at a level way above your head. Then he runs out the door and leaves you lost, because the patient(you) is to embarrassed to ask him to explain, they think they trust their doctor and he knows best. But does he always ?? No its your body for peets sake!!! you as the patient deserve a detailed play by play of your care, your treatment, your medications, any questions you have, all explained to you in plain ol' English, not medical jibberish that you do not understand. As a nurse for nearly 30 yrs, I don't understand some of that jibberish at times, so don't feel bad!Now back to Amanda Trujillo... if you don't know her story, I encourage you to read, search and learn all about this, it may very well change our profession as a whole.

Okay so, after reading a ton of books trying to find a definition of nursing that matched my experience, I fell asleep with no clear cut answer to my question, “What is a nurse?”
I mean it’s not that I haven’t been pondering that for a very long time, it’s just that nothing so far has satisfied me. I’ve seen brilliant bedside nurses–and I don’t mean nurses who only cared for patients with superb care and compassion– I mean smart, really smart diagnosticians. Nurses who doctors asked, “What do you think is going on with this patient?” And when they answered, there was true appreciation and respect from the doctor to that nurse. They were colleagues, no question there.
I’ve seen ICU nurses, who both doctors and patients trusted to look at a monitor, administer meds — both stat and with standing orders — who saved patients lives time and time again, before a doctor ever could get to the Unit.
I watched patients pour their hearts out to a nurse, the way children do to their mothers, tears flowing, nose running, sobbing, when they felt hurt and broken over news of a sickness that snuck up on them, and heard doctors sigh with relief and appreciation when nurses did the emotional heavy lifting. No one ever asked what degree the nurse had, or even where she went to school. If a nurse was good at her job, she was a “good nurse.”

Suppose you are very sick - terminally ill. You've been through the ringer with so many drugs, so many different forms of treatment, difficult side effects, very little quality of life... now your doctor wants you to have ONE MORE THING - surgery. If the surgery works, then it will keep you alive longer.
Since you trust your doctor, you make arrangements for the surgery. You have no idea what to expect. You don't really know anything more than the fact that when you wake up, the surgery will be over. You're not sure how long you'll be hospitalized, or how long it will take to recover. But you're excited because you'll live longer! So your feeling is... you just really want to get it over with.
But wait!
Along comes a nurse who spends some time with you as you lie in your hospital bed. Since you realize you know next to nothing about your impending surgery and what to expect, you start to ask her some questions....
The more answers she gives you, the more you realize... maybe this surgery isn't what you want after all. You had no idea what was involved, how debilitating it will be, how much pain you'll be in, how much it will impact any quality of life you have left, even how risky it is - and it IS risky. You didn't even know you had a choice.

Advocating for a fellow Nurse: Amanda Trujillo, MSN, RN, DNSc-NP(s)

Disclaimer, I have not been directly contacted by Amanda Trujillo, nor do I know her personally or professionally. I am also writing to you based on the information that I have available to me.
To the Arizona State Board of Nursing:
To whom it may concern,
I am writing to you on behalf of Amanda Trujillo, MSN, RN, DNSc-NP(s) regarding the case attached below. I have not been contacted directly by Amanda Trujillo, and I have neither a personal or professional relationship other than that she is a fellow nurse in need of my support.
Based on the information I have (to my knowledge the same case documents that you also have), I would like to ask the board to carefully consider the information presented by both Ms. Trujillo and her legal team. From my understanding, it appears that Amanda Trujillo evaluated the health status of her patient based on her own clinical assessments and also data collected while being treated by the medical team at Ms. Trujillo’s place of employment during this time. It also appears from the information that Amanda Trujillo provided health teaching, counseling, and advocacy for her patient, which to my understanding of the Nurse Practice Act is well within her scope of practice.
As a nurse and patient advocate, I make certain that each and every patient I provide services to does in fact receive the highest quality nursing care while on my case. It should go without saying, but part of this care involves my ongoing support to ensure that my patient is knowledgeable about their diagnoses, medications, and ordered treatment plan. It is my job to protect the health and safety of each and every patient that I come into contact with, and to advocate for their needs based on my clinical judgement.
I am not in any way assuming that the treating physician was negligent, however considering that this is, and should have been a collaborative approach in the patient’s care, Amanda Trujillo was making her own nursing diagnosis based on her clinical assessment, which again to my knowledge is within her scope of practice as a registered nurse. She apparently discovered a deficit in her patient’s knowledge about their treatment options, and it appears that she acted ethically in supporting her patient’s wishes to seek additional information, and referred the patient to a case management specialist as per protocol.
I realize that these cases can carry with them a great deal of emotion due to the sensitive nature that our number one priority as licensed nurses is to protect our patient’s health and safety. It seems that Amanda’s duty to uphold the rights of her patient is being challenged, and the circumstances in which this transpired seems to have been initiated and fueled by emotion, and not based on facts. I just ask that you please consider all of the information presented to you, evaluate this case objectively, and if Amanda Trujillo is exonerated from these allegations, that she have the opportunity to continue to practice professional nursing.

To my fellow nurses, and to you Amanda, I assure you of my undying commitment to this profession that lateral abuse and nurse retaliation will not be tolerated in my presence, and that my voice will be heard with yours. Nurses, one united voice can be very powerful. Let’s use it for something amazing; to elevate nursing to the highest level as one of the most honorable and respected professions.

Lo, a Tweet from Banner Health on the Amanda Trujillo incident, and possibly the most content-free in the history of Twitter:
Uh, huh. “Listening” and “hearing” rather imply, in this context, some sort of follow-up action (though I think Banner Health SM guru is advising the appearance of action, rather than any actual action, to fool the rubes, i.e. us.)
Given that for reasons of confidentiality employee matters won’t be discussed, there are still plenty of things Banner Health might talk about.
To wit, ten questions for Banner Health:
1. Does Banner Health have a written zero tolerance policy against abusive behaviour? If so, who deals with complaints? Does the policy apply to physicians and managers? If so, how are they disciplined?
2. What steps is Banner Health taking to ensure patients are fully informed of their treatment options at all times?
3. What steps is Banner Health taking to clarify the process for ordering team consults?
4. Does Banner Health have a stepped or graduated disciplinary process?
5. Under what circumstances may an employee be fired pre-emptively? For example, for med errors? For abusive behaviour? For theft?
6. In what ways specifically does Banner Health support nurses to act as patient advocates?
7. What is Banner Health’s understanding of collaborative practice?
8. Under what circumstances may a physician override the concerns of a nurse? Of a patient?
9. How much training do managers receive annually on nursing ethics and practice?
10. Is it written policy to refer nurses to the state board of nursing for any violations of hospital policy? Under what circumstances is that decision made?

Last spring, Banner Health took action against an Arizona nurse who counseled, even encouraged, a prospective transplant patient about hospice care. With 6 years of nursing under her belt, the nurse (whom I’ve declined to name), identifies herself as a nurse specializing in cardiology, geriatrics, and end of life/palliative care. In the wake of her dismissal from the hospital, and loss of her nursing license, thanks to blogs and online communities throwing her support, she’s now been dubbed a patient advocate. As of January 2012, at the request of the Arizona State Board of Nursing, she’s scheduled to undergo a psychiatric evaluation.
In the nurse’s own words: “I had discovered (patient) had no clue about what they were about to participate in when they agreed to get a major invasive surgery. When I properly educated the patient using the allowed materials by my employer they became upset that the physician never explained details of the surgery or what had to be done after the surgery (complex lifetime daily self care).”
In a typical medical practice, or hospital – it would be the doctor or surgeon, the one with the medical degree, who would be responsible for educating the patient about surgery. Nurses are trained, and hopefully well trained. They are not, however doctors, or surgeons. While nurses, good ones anyway, forge relationships with patients, it is not the place of a nurse, with 6 years of experience, or 60 years of experience, to counsel a patient into hospice care, especially when the patient is scared or is lacking information about surgery. The surgeon is qualified to, and prepared to, explain thoroughly, as many times as necessary, any medical procedure a patient is undergoing. A surgeon will typically explain the surgery, and after care needs to the patient as well as the patient’s family.
Also worth noting is that there is procedure in place for initiating Hospice care. I am not affiliated with Banner Health, however, as is standard in most hospitals across the country, hospice care is not initiated by a nurse, and certainly not without the knowledge of the attending physician. I’ve been disillusioned by the huge outpouring of support the nurse has received. Not only do I have personal experience (that I share below) that’s shaped my opinion on this matter, I take offense to the supporters who have adopted the attitude that this nurse was fired because she upset the attending physician, and threatened the dollars attached to a transplant procedure.
