No Legal Recourse Against Facility or Psychiatrist?
Charleston v. Larson, 696 N.E. 2d 793 – IL 1998
Summary: It would seem absurd, that if a physician admits and facility assigns a nurse to care for a known violent patient, that it has no legal obligation to protect that nurse against violence. In this case, a psychiatric patient sought admission to facility. On admission, he threatened to attack a nurse. When the patient would follow through on his threat, the nurse was denied legal recourse against the psychiatrist who could have taken precautions against the attack.

Two-thirds of states cut mental healthcare funds: advocacy group | Reuters

Two-thirds of states cut mental health funding from their general fund budgets over the last two years, according to a report released by a mental illness advocacy group on Wednesday.

Kentucky with 47 percent, Alaska with 35 percent, and South Carolina and Arizona both with 23 percent made the largest percentage cuts to mental health spending in their general fund budgets, which do not include federal Medicaid funding, the study by the National Alliance on Mental Illness (NAMI) found.

"Cutting mental health means that costs only get shifted to emergency rooms, schools, police, local courts, jails and prisons," said NAMI executive director Michael Fitzpatrick. "The taxpayer still pays the bill."

"Some states are trying to hold the line or make progress, but most are cutting deep. This stands in contrast to the intense national concern about the mental health care system following the Arizona tragedy two months ago," he said.

Low levels of psychological distress are linked to long-term disability, study finds - latimes.com

Even a little psychological distress adds up over time, according to a new study published online Wednesday in the Journal of Epidemiology and Community Health.

British and Swedish researchers looked at a 2002 survey of more than 17,000 Swedes in Stockholm County, and asked them a series of questions to rate their levels of psychological distress on a scale of zero to 12. Zero means no distress, 1-2 is mild, 3-7 is moderate and 8-12 is severe.

They then checked to see how many of these people had enrolled for disability pension awards in 2007. They found that the higher the level of psychological stress, the higher the likelihood that people would need a disability pension award five years down the line.

Occasionally, news reports of out-of-control celebrities spur an increase in interest and admissions as more people seek treatment, said Robert R. Johnson, DO, medical director of Sierra Tucson, an addiction and mental health treatment center in Tucson, Ariz.

But celebrities who have gone public about their treatment have the most positive impact encouraging others to seek help. Some examples are Betty Ford's battle with alcoholism and drug dependency and Patty Duke's honesty about her bipolar disorder, he said.

"When people in the public eye own [up to] their struggles with depression, mood cycling or substance abuse, it has led to both heightened awareness and a greater openness for treatment within the general public," Dr. Johnson said.

Prevalence and Correlates of Eating Disorders in Adolescents: Results From the National Comorbidity Survey Replication Adolescent Supplement, March 7, 2011, Swanson et al. 0 (2011): archgenpsychiatry.2011.22v1

Lifetime prevalence estimates of anorexia nervosa, bulimia nervosa, and binge-eating disorder were 0.3%, 0.9%, and 1.6%, respectively. Important differences were observed between eating disorder subtypes concerning sociodemographic correlates, psychiatric comorbidity, role impairment, and suicidality. Although the majority of adolescents with an eating disorder sought some form of treatment, only a minority received treatment specifically for their eating or weight problems. Analyses of 2 related subthreshold conditions suggest that these conditions are often clinically significant.

Despite Tucson Shooting And Rising Needs, Mental Health Given Low Budget Priority

It's been two months now since Jared Lee Loughner opened fire outside a Tucson, Ariz. shopping center killing six people and wounding 14 more, and what's come to light since leaves more than a few troubling questions.

In the days following the shooting, it was revealed that authorities had barred Loughner from Pima Community College, where he attended classes, until he was certified as fit by a mental health professional. Loughner apparently never sought professional help, and the questions the community college had about Loughner's state of mind still resonate -- what was going on with this young man, and is there anything the local mental health infrastructure could have done to change the horrible outcome?

Calls to Suicide Hotlines Skyrocket Along with Unemployment | Poverty in America | Change.org

Wayne Zickefoose was facing a desperate situation. With an impending foreclosure and a mountain of credit card debt, he must have felt there was no way out. On June 13th, he picked up a handgun and shot his wife and 3-year-old son before killing himself.

The tragedy isn't just an isolated incident. As joblessness rates rise, people are getting desperate. One of the saddest signs of the continuing recession to date, calls to suicide hotlines have risen nearly 20 percent.

We've chronicled how many people have been without a job for over two years, and how companies have begun to discriminate against the unemployed. Legislators are even making unemployment synonymous with criminal behavior, calling for drug testing for people receiving jobless benefits. Add to that serious debt, eviction, foreclosure and the like, and it's easy to see how it has become a perfect storm that is likely leading to rising suicide rates.

Although federal statistics on suicide rates are usually two to three years behind, counting the number of calls coming into a suicide hot line is a much more timely measure of how many people are facing desperate circumstances. The National Suicide Prevention Network, which operates hotlines around the country, says rates of calls have jumped 18 percent just between January and May of this year.

Summary: It would seem absurd, that if a physician admits and facility assigns a nurse to care for a known violent patient, that it has no legal obligation to protect that nurse against violence. In this case, a psychiatric patient sought admission to facility. On admission, he threatened to attack a nurse. When the patient would follow through on his threat, the nurse was denied legal recourse against the psychiatrist who could have taken precautions against the attack.
