Medical News: Supreme Court Sides With Vaccine Maker - in Washington-Watch, Washington Watch from MedPage Today

The Supreme Court has ruled 6-3 that a federal law shields drug companies from being sued over injuries caused by childhood vaccines.

The case was brought by the parents of Hannah Bruesewitz, now a young adult, and charges that she developed a seizure disorder after receiving her third dose of the diphtheria-tetanus-pertussis (DTP) vaccine when she was 6 months old. She has suffered developmental problems ever since, and will likely require medical attention for the rest of her life, her parents say.

The dose of the vaccine in question, TRI-IMMUNOL, came from a lot that generated 65 reports of adverse reactions, including 39 emergency room visits, six hospitalizations, and two deaths, according to documents from the U.S. appeals court that heard the case in 2009.

The National Childhood Vaccine Injury Act of 1986 created a so-called "vaccine court" to address safety claims in an attempt to ease the threat of lawsuits in state courts against pharmaceutical companies and insure against them pulling out of what they claim is an unprofitable vaccine marketplace completely.

Under the law, people injured by vaccines are eligible for compensation for medical care, rehabilitation, counseling, special education, and vocational training expenses; diminished earning capacity; pain and suffering; and $250,000 for vaccine-related deaths.

For 12-year-old Buffy of Calabash, N.C., the trouble began with too much steak (and chicken and ice cream) at dinnertime. In nearby Ocean Isle Beach, six-year-old Hershey harbors a fondness for beef and cheese snacks. And 14-year-old Fridge of Longwood, Fla., gets cranky if his bowl isn't full.

Buffy, Hershey and Fridge are pets battling excess weight and obesity. As more Americans confront their own weight issues, furry housemates increasingly struggle alongside them. New data due out this week indicate the problem is reaching epidemic proportions, with more than half of U.S. dogs and cats now overweight or obese. Of pets considered to be "obese"—defined as 30% above normal weight—one-fifth of dogs and cats fit the bill, according to the Association for Pet Obesity Prevention, which conducted the survey with Mars Inc.'s Banfield Pet Hospital, the nation's largest general veterinary practice.

The main culprit: owners who routinely overfeed pets, don't exercise them enough and are unaware of the severe, and costly, health problems caused by excess weight. Common woes include diabetes, arthritis, kidney failure, high blood pressure and cancer. Research also suggests that pets fed less over their lifetime can live significantly longer.

Make Way for the Millenials on ADVANCE for Nurses

Millions are already in the classroom and workforce, and their reinforcements are marching through the doors in vast numbers. They are the millennials, the latest generation to give the country a facelift as they try to blend in with the traditionalists, baby boomers and Generation Xers to do their part in moving society forward.

The millennials were born between 1982 and 2001.1, 2  The children of baby boomers, their generation was named for coming of age at the turn of the millennium.

Millennials are a symptom of drastic change, according to Paige Shaughnessy, PhD, CCC-SLP, graduate program director in the Department of Communication Sciences and Disorders, School of Allied Health Professions, at Loma Linda University in Loma Linda, CA. "The changes in America socially, economically and politically were so drastic around 2000 and 2001 that in many ways it shaped a generation that is very different from the rest of us. We truly have to struggle to understand them."

The older generations can learn to work with the incoming workforce of millennials by making every attempt to understand their characteristics, values and expectations without sacrificing their own integrity.

Millennials have a wealth of defining traits. Thanks to their total immersion in technology from the time they were born, their cognitive characteristics and learning styles are unlike any seen before. They really are wired differently because they grew up using different parts of their brains, Shaughnessy told ADVANCE.

David Stoner notices that his opinion has recently become a lot more important to the staff who treats him at the Dillsburg Family Health Center.

Before, I was pretty passive, just doing what the doctor said. I can tell they are trying to get me more involved,” said the 64-year-old Lower Allen Twp. man who has diabetes.

The Dillsburg Family Health Center, a service of Holy Spirit Health System, is the site for the health system’s first “medical home” — a patient-centered, comprehensive approach to care that coordinates all facets of a patient’s care and medical history. This approach makes patients active participants in treatment decisions and improves communication between a patient’s health care providers.

It’s working for Stoner, who said he now takes his goal of losing weight and exercising more seriously, perhaps because he is the one who came up with it.

The concept of a medical home is one of several emerging trends in medicine as the industry seeks to prepare itself for aging baby boomers, take advantage of cost-effective technology and, ultimately, deliver safer, better care for patients.

Here’s a look at the effects of some of those trends in the midstate.

Obama administration asks states to cut costs without dropping Medicaid coverage

The Obama administration is deploying squadrons of in-house experts to help budget-strapped states figure out how to save money on Medicaid, the health program for the poor that has been a source of rising tensions between state capitals and Washington.

In recent weeks, both Democratic and Republican governors have been pressing the administration to be flexible in enforcing a requirement in the new health-care law that bars states from tightening eligibility for the program between now and 2014, when an additional 16 million people will be eligible for the program. Some states want to tighten eligibility now to curb spending.

Health and Human Services Secretary Kathleen Sebelius has a difficult balancing act. The former governor of Kansas wants to improve relations with the governors, who are due Saturday in Washington for a big meeting. But she also wants to expand Medicaid, not shrink it.

Officials at Tift Regional medical center recently installed Electronic ICU monitoring systems in each room of their ICU.

Now doctors and nurses have an extra set of eyes on all of their ICU patients 24 hours a day and these professionals are monitoring from hundreds of miles away.

In the Intensive Care unit every moment counts, "You can save a life in just a few minutes," said Dr.William Guest, Chief Medical Officer of Intensive Care at Tift Regional.

Doctors and nurses at Tift Regional always keep a close eye on patients in the ICU, but now they have a hi-tech way to monitor every single ICU patients twenty four hours a day.

It's called Electronic ICU, and it doesn't replace the doctors and nurses, it just adds on an additional layer of protection. "It is access to a critical care physician 24 hours a day using newer technology," said Guest.

Critical care doctors, and nurses in St. Louis Missouri are constantly monitoring ICU patients in Tifton and have access to everything doctors have access to, "The Advanced ICU Care has access to the patients chart, the x-rays and the laboratory tests," said Guest.

Violence Against Nurses, Attacked At Work, Is Hospital Liable?

It's a good question and one governed by your hospital and how well it values the safety of its employees.

 

In most states the only liability a hospital has, is providing "workers compensation" for employees hurt on the job.

 

If the hospital was grossly negligent in protecting you, you could sue, but most laws are written to protect employers.

Violent Psychiatric Patient Attacks Nurse, No Legal Recourse Against Facility or Psychiatrist?

Charleston v. Larson, 696 N.E. 2d 793 – IL 1998

 

Summary: It would seem absurd, that if a physician admits and facility assigns a nurse to care for a known violent patient, that it has no legal obligation to protect that nurse against violence. In this case, a psychiatric patient sought admission to facility. On admission, he threatened to attack a nurse. When the patient would follow through on his threat, the nurse was denied legal recourse against the psychiatrist who could have taken precautions against the attack.

In New Jersey recently, a law was passed making it a felony, to assault a nursing professional.  You can bet, policies are being changed in our hospitals now that assaulting a nurse is "Aggravated Assault." New York and several other states are pushing these laws through.  Perhaps you can suggest them to a local politician.

 

Madden legislation to upgrade the offense of assaulting a nurse in N.J. now law:"Legislation to upgrade the offense of assaulting a nurse or other health care profession to aggravated assault was signed into law Wednesday by Gov. Chris Christie.

 

The law — whose sponsors include Sen. Fred Madden, D-Washington Township —  upgrades the offense for any individual who assaults a nurse or other healthcare professional, while in the performance of his or her official duties, from a simple assault to aggravated assault. If the nurse or healthcare professional suffers bodily injury as a result of the assault, it will be classified as a third degree crime; otherwise it will be a fourth degree crime."

However it comes down to how your nurses and security staff react.  If you're dealing with violent patients and getting hurt on a regular basis, you need to demand that your hospital do a better job of protecting their staff.

 

Gather some statistics from the police department and ask a local reporter to do a story on "violent patients" in the ER.  The welfare of nurses is only as important as we remind people it is.

 

Write a letter to the editor praising the security staff for the great job they are doing keeping patients safe, and mention also the heavy cost they pay.
