Silent Treatment Study, silenttreatmentstudy.com #rnchat #nursing #nurses

Research and regulatory bodies have long confirmed that poor communication in healthcare is harmful at best and deadly at worst.

In the 2005 study, Silence Kills, VitalSmarts and the AACN found that 84 percent of healthcare professionals observe colleagues take dangerous shortcuts when working with patients and yet less than 10 percent speak up about their concerns.

Since that time, the healthcare community has turned to safety tools and checklists to reduce unintentional slips and errors. And yet, a new study called The Silent Treatment has found that the effectiveness of safety tools is undercut by undiscussables. Every day, healthcare professionals are making calculated decisions to not speak up—even when safety tools alert them to potential harm.

The Silent Treatment reveals that despite the safety interventions taken in the last decade, silence still kills. Safety tools do not compensate for crucial conversations failures in the hospital.

How podcasts can help patients with health literacy, KevinMD.com

by Robert Rodvien, MD

When a person is told that they have a serious illness, they are similar to Alice falling down the rabbit hole.

They enter a bewildering new world of discussions, tests and treatment programs that must be navigated while maintaining a job, life obligations, and relationships with friends and family. Just when a person needs more resilience to stress, anxiety can occur. The ability to function is often diminished in such a state, and, like Alice, many begin to grope for solutions. Patients, family members and friends begin to rely on anecdotes. Others find hope-based messages more acceptable than evidence-based ones. Some patients are willing to do anything that appears constructive even if there is no evidence of success.

Some patients seek to become experts in their field of illness and venture on-line to do so, but entering the world of medicine on-line often creates misguided but nonetheless strongly held beliefs. Much of the accessible material is jargon and advertising rather than unbiased information. Web sites and brochures are rife with marketing language to promote a hospital, company or pharmaceutical product, leaving many who seek information as wary consumers instead of informed patients.

The Medical Quack: HealthGrades And Other MD Rating and Referral Sites List “Dead Doctors” on Their MD Information Pages And Even Include the Insurance Plans the “Dead Doctors” Honor

This just goes to show you can’t really believe every thing you read on the web.  I came across this by accident when doing some searches relative to the Medical Quack.  I went to an obgyn doctor for many years and was very happy with her and would still be a patient today except for the fact that she unfortunately passed away from breast cancer.

image[4]

These sites are supposed to “rate and “help” people but I am not convinced how valuable they are when I see my former physician who has been dead for around 6 years still listed and according to the site, she takes HealthNet.  You can read on the site about the focus on helping hospitals with marketing and other software and management areas of business.  I guess they are too busy marketing to look for a little bit of accuracy here with the physicians they provide information for.  Marketing captures all today.  I did call her old phone number out of curiosity and it said it had been disconnected so goodness forbid that phone number being given out to anyone else here, they would kill the phone company with all the wrong numbers due to a listing as such.

Presentation Cites Ways to Counteract Low Health Literacy | National Nursing News

Although low health literacy is a significant barrier to quality care, especially among elderly patients, a recent presentation noted how increased use of simple health literacy assessment tests by nurses and clinicians can help improve communication and health outcomes.

Several screening tools are available to assess health literacy but are underutilized, according to a presentation at the 36th Annual Congress of the Oncology Nursing Society by Ellen C. Mullen, RN, ANP-BC, GNP-BC, nurse practitioner in the Lymphoma and Myeloma Center at The University of MD Anderson Cancer Center.

Furthermore, nurses and other health professionals routinely underestimate the prevalence of limited health literacy — the degree to which an individual can obtain, process and understand health information needed to make appropriate health decisions — and overestimate patients’ ability to understand medical information.

What Nurses Wish You Knew - Philadelphia Magazine - phillymag.com

No matter what health-care reform winds up looking like, one thing’s certain: Nurses will play a bigger role than ever, taking over duties from doctors, moving out of hospitals and into the community, looking after frail aging boomers, leading the push to keep costs down and improve outcomes. So this seemed the perfect time for a consult with the people who really run health care in Philadelphia. As one nurse told us, “Doctors only think they’re the quarterbacks.” Here’s what nurses had to say about their work, their patients, life and death, and those little white caps they used to wear.

1 // It’s okay to buzz // Really. Go ahead. Room too cold? Need a pillow? Got a question about your meds? Use the buzzer; that’s why they put it there. “My 82-year-old mother was just in the hospital for a stroke,” says Presbyterian Hospital’s Michael Becker, “and she said, ‘I can only hit the buzzer two times a day.’ I asked, ‘Why is that?’ and she said, ‘Because they’re going to get tired of seeing me.’ I said, “No, no, Mom, it doesn’t work that way.’” If somebody’s pushing the buzzer all the time, nurses know there’s a deeper issue and work to address it.

2 // You don’t have to be afraid // Nurses understand that patients often don’t speak up because they feel vulnerable. But when we don’t voice our thoughts, they have no way of knowing what needs improvement—until the patient-satisfaction survey arrives after the fact. And they hate finding out there was something they could have fixed if they’d known about it. “It’s natural to be fearful,” says Pennsylvania Hospital’s Mary Del Guidice, “because you’re lying in bed with all these faces looking down at you. But don’t be afraid of us.”

Nyack Hospital's Code H Spells Safety and Satisfaction | New Jersey Nursing News

Nyack Hospital, Nyack, N.Y., has launched a system where patients and their visitors can trigger levels of rapid response. Impetus for the innovation came after the well-publicized medical error that ended in the death of 18-month-old Josie King at Johns Hopkins in Baltimore, Md., and the resulting focus on patient and family involvement in acute care.

Although patients and families can use the system to alert staff about potential emergency situations, such as chest pain, it also offers the reassurance that help is nearby. This is in case patients experience delays in bedside care, pain medications, and more, according to Ginni Norton, RN, MS, Nursing Performance Improvement, Nyack Hospital, a member of the NewYork-Presbyterian Healthcare System.

A team approach

Nyack Hospital patients and their visitors can call 3-1-1-1, which goes directly to hospital operators. The operators have been trained to ask callers questions according to an algorithm. Callers who report something physiological, such as bleeding or chest pain, are be routed immediately to rapid response. The call can trigger a team, including the nurse manager from the patient's unit, house physician, respiratory therapist, critical care nurse, and pharmacist.

DEFECTIVE PRODUCTS, Bonina & Bonina, PC:"When people buy or use products, they expect them to be safe. In fact, manufacturers, distributors and sellers of products have a duty both make products safe and to warn users of the product of any potential dangers. Unfortunately, many products are put on the market which are unsafe and can cause serious injury to people using them. The Med Law team has a complex litigation unit that deals with cases where people have been catastrophically injured as a result of defective products. We have successfully represented people injured in vehicle rollover accidents caused by their vehicles being top-heavy, people who were ejected from their vehicles due to faulty seatbacks, cases involving defective machinery, defective meat cutters, defective punch presses and defective seatbelts, as well as cases involving household objects like lounge chairs and step ladders."

Limiting Your Liability, Entrepreneurmag.com:"What happens if you sell a product with a dangerous defect? Q: Who is ultimately responsible in the event someone uses our product and then tries to file a claim for injury, misuse, accidents and so on? If we get liability insurance, include disclaimers on our Web site and provide warnings on the product itself, are we still potentially liable?"

Product Liability: Manufacturing Defects vs. Design Defects, Findlaw.com:"Introduction: When a product injures someone, a court will ask the same sort of questions you would: How did the injury happen? Was there something wrong with the product? How badly was the person injured? Although these questions seem simple, the answers can be surprisingly complex. Courts faced with the question "was there something wrong with the product?" use two general theories to analyze the facts surrounding the injury: products liability (sometimes referred to as strict products liability) and negligence. To some extent these theories overlap or blend but the basic difference is that products liability focuses primarily on the product itself while negligence focuses on the manufacturer, seller or distributor's conduct as well as the product. Both theories look at what was wrong or defective in the product."

Product liability answers from PritzkerLaw.com:"Pritzker Ruohonen & Associates is one of the leading product liability law firms. A product is "defective" if an ordinary user or consumer could not have anticipated the danger the product created. The defect may be caused by the way the product was manufactured, assembled, inspected, packaged or tested. From a practical standpoint, that means you have to ask these questions about the product that caused your injury."

******************************************************

A Viable Product vs. The Legal System, Scientific Advisory Services, Ltd:"In the United States, the most litigious country in the world, a products liability action may be brought, under state law, for express or implied breach of warranty, misrepresentation and negligence. Under the theory of strict liability, a lawsuit may be initiated on the grounds of manufacturing and design defects as well as poor and inadequate warning instructions. The best defensive strategy for a company to avoid becoming involved in any of the above is to manufacture the safest product possible within parameters of economic feasibility. If said manufacturer can vouch for safety factors in the design, production, testing, inspection and evaluation of its product as well as attentiveness to consumer complaints, it will be more likely to avoid litigation or at least be able to prevail in the courtroom. This paper will discuss the creation of a potentially safe product: the protocol involved in the development, prototype testing, engineering evaluation, hazard analysis, and the production of warnings and instructions. It will also emphasize the factors necessary to keep a company from becoming entangled in the legal system so that it can spend more money on product improvement, product safety and viability."

How Strict is Your Liability? Risk Review Online:"Did you know your company could be sued if a customer is injured while using a product you manufacture, even if he or she used the product incorrectly or didn't follow directions? According to the legal doctrine of strict liability, your company could be held responsible even if there is no evidence of corporate negligence. In today's litigious society, manufacturers risk losing substantial sums in compensatory and punitive damages resulting from product-related accident and injury claims."

Product Liability: Preventing Deaths From Tire Explosions Caused By Known Design Defects By Richard Alexander:"It is a strong but true statement that tires are designed to explode when being installed on wheels and for that reason, every tire explosion that occurs during the installation process, whether a passenger or light truck tire, is predictable and preventable result of a known design defect. This design defect has been known since 1955 when Firestone engineers publicly confirmed that the failure of the bead during mounting of the tire commonly occurs in a predictable location and recommended a simple method to avoid failure."

Product Liability, Weitz & Luxenberg:"If you have been injured, or you know someone you know has been hurt or killed by a defective product, Weitz & Luxenberg can help you. Manufacturers have a duty to design and manufacture products that are safe for their consumers to use. They are also required to alert consumers of any potential problems related to their product. When a manufacturer creates an unsafe product, or when they fail to warn consumers that their products might be dangerous, people may suffer as a result. If you have been exposed to a dangerous product, such as a defective automobile, motorcycle, toy, or medicine, and you have been injured, you may be eligible for significant financial compensation. Weitz & Luxenberg is one of America's foremost mass tort/products liability law firms, and has achieved prominence in many national litigations. The firm is currently representing thousands of individuals with their Asbestos, Propulsid, Rezulin, Baycol, and other products liability and personal injury claims. With over 50 attorneys and 250 support professionals on staff, Weitz & Luxenberg is eminently qualified to provide you with the best possible legal representation."
